Please solve my query quickly.
today in one case under sec.138 of N.I. act the advocate of accused demanded to translate the whole suit in vernancular language i.e. in GUJARATI, in JMFC.
We r generally doing court proceeding in english.
Is there any article/ section/ or latest judgement that make compulsion to do so?
Pl source me judgements in favour and against us.
It is very urgent for us.
judge also urged us to do so if we fail to prove that there is no such provision that bind us to translate the suit in Varnencular...

There is no such citation vide which he may compel you to translate the complaint in vernacular language. As they are insisting, you require such citation/notification etc. from them notifying.

There is no citation.They can't compel you to translet the complaint in Gujarati or any other vernaculary language.

There is no citation, but when it is asked to supply the complaint in local language tjhen u have to. One week back same thing happened in our one of the courts. Court directed the compalainant to supply the complainant to the accused in local langauge. When a person is uneducated and cannot understand the other languages except the local language then we have to supply it in the local language.

There is no such citation. Here in Maharashtra, the state Govt. declared the language of court is Marathi. Hence, generally in lower courts the Judgements are passed in Marathi. But I think, no one can compell to work in vernacular.

AS PER THE PROVISION LAID DOWN BY SECTION 272 CR.P.C THE LOWER COURTS INCLUDING THE SESSIONS JUDGE IS BOUND TO USE THE LANGUAGE IN A COURT WHICH IS DETERMINED BY THE STATE GOVERNMENT CONCERNED EXCEPT IN A HI COURT. IN GENERAL STATE GOVERNMENTS PROVIDS THE STATE LANGUAGE AND ENGLISH. IF UR STATE GOVT HAS PROVIDE GUJRATI THEN U BOUND TO TRANSLATE. IF NOT UR NOT BOUND TO TRANSLATE.

There is no such citation vide which he may compel you to translate the complaint in vernacular language. They can't compel you to translet the complaint in Gujarati or any other language.
