Court fee calculation in property dispute

(Querist) 20 May 2013 This query is : Resolved
Dear Learned Friends,

Few friends of mine have contracted for purchase of villa plots on which the developer through its own builder was to construct villas for them in Bangalore. There is no trace of the developer for the past few years and the builder has stopped construction too. One has got the land registered in his name while another has only got an agreement to sign in his favour. They intend to initiate legal action against property developer for specific performance and/or possession and/or restraining them from alienating it to anyone else.

Can anyone please advise how the Court fee is calculated in order to file case against the developers in the Court. The builder has constructed only portion of the contracted dwelling units.

I will be very thankful for any advise in this matter.

Regards,
Aravind

Court fee is different from State to state so better to get this information locally from the diary of any lawyer.

Mere filing civil suits will not solve your problem. To teach him a lesson you have to file criminal cases against the developer. As the developers will be influential persons, you should process the police work from higher police authorities like ACP, DCP, commissioner of police.

My advise is instead of filing civil suit, you go for consumer case. It will save your money. The court fee in consumer is very meagre.
