Complaint against samsung mobile company for faulty handset

My daughter purchase a Samsung handset for Rs. 21,500/-from a local dealer M/s Univercell , Chennai having nos of outlet in TN throgh SCB Credit card with 15% money back scheme. whereas the company fix priced through Ad 21,490/- handset started troubles in 5 days. She asked for replacement. both of them refused to replace. and dealers sales people misbehaved with my daughter asked her to get out. After that issued legal notice asking refund of money and demage from 1 & 2 AND FOR separate claim for excess invoice and no address of sales outlet of 2 and for misbehave from 2 salesman. I need advised how I can file suit in CDRF for refund and excess billing and inv without address of sales outlet and with other Court of Law. Pl. provide me specimen and advise accordings thanks in advance

You should file a case in District Consumer Forum for deficiency of service,unfair trade practice and mental agony.You can also file a criminal Case in Magistrate Court,no need to file other cases.

1) you must be having bill of samsung hand set
2) since defect occured within period of 15 days it would be covered under warranty .

3) the compnay would repair the set . only if hand set cannot be repaired would it be replaced .
4) you have not mentioned whether they offered to repair the hand set .
5) if they have refused then file comploaint before consumer forum
6) mention detailed facts of the case and reliefs claimed by you
