Summon received

(Querist) 04 May 2013 This query is : Resolved 
Hi Experts,

Today I have received the summon from the court but my lawyer asked me to not to accept the summon( have to appear on 5th may in the court).

The reason my lawyer put forth to reject the summon is "It is very short period of notice ".

Please let me know will this create any problem for me? and also what is the next step I/My lawyer have to do..

Please give a assistance as I am highly worried.

I always suggest one has to accept the notice / summons and contest the case on merits. If notice period is short, one can appear in the court on the date of hearing and ask the court for adjournment. If the notice went back with a remark that you refused to accept it, the court is competent to proceed ex-parte or if it takes a lenient view, it may serve another notice. My suggestion is to appear on 5th May and seek time to avoid the possibility of ex-parte orders.

it is always advisable to appear after service of summons . you can always take a adjournment .

Don't avoid to receive summon,it may create you problem.court may pass Ex-Parte order against you.Better get receive summon and put your appearance in court and ask adjournment.

Anyway attend the court when the date is fixed so no ex parte order can be passed.

First of all, it was improper on the part of the Lawyer to advice your not accept the summons. Anyway, irrespective of the fact that you might have refused to accept the summons, it is suggested that you should appears before the court, explain the position and obtain a fresh date. Number of competent lawyers are enlisted in the database of this site and you may choose one practicing in the courts at Chennai.
