critaria to decide "decree with legal charges"

i have come across 1]decree granted WITH LEGAL CHARGES 2]without legal charges.Therefore i'm interested to know the legal aspect/rules governning this order.Is it DESCRETIONERY ORDER? if possible explain with reference to cases in co op courts/other courts in maharashtra.riven

If decree has been passed with cost then the decree-holder can recover the cost of decree from judgment debtor otherwise not. Generally courts pass decree with cost if it transpires that the respondent has played a big mockery with the plaintiff and has forced him to approach the court for redressing his grievances.riven
