Resale of flat under construction

(Querist) 05 March 2013 This query is : Resolved 
I wish to buy a flat under construction from an investor [A} who has entered to sale agreement with the builder [B]. The said agreement is registered with the sub registrar and the payment is to be made as per progress of work even though initial amount of Rs.15 Lakhs has been paid by A.Pl clarify whether the agreement to be entered into with A by me is to be countersigned as a consenting witness by the builder B or mere NOC from Builder will do. Whatever agreed with A by the builder is automatically binding upon the builder for discharge of his obligation to me. Or a triparty agreement to be signed among A myself and the Builder B. Send a draft of the same.

Both A and B should join you in the sale deed along with land owner of the site if there is any apart from B.
