Devajyoti Barman (Expert) 13 January 2013
Bail is matter of right after 90 days only if the charge sheet is not filed. If it is filed within that time then the under trial may be trial in custody.
Raj Kumar Makkad (Expert) 14 January 2013
Bail is a discretionary right of the courts though such discretion is required to be used judiciously. There is no such legal requirement to grant bail within 90 days of arrest or filing of charges-sheet.
