Regarding appearing of an ias probationer on national television

Sir,
I would like to know if an IAS probationer can appear on National television in shows like KBC (Kaun banega Crorepati) or not.
The IAS(probation) rules, 1954 does not prescribe anything relating to this. My brother, who is an IAS probationer, has got a call from KBC. He is planning to skip Bharat Darshan (which is a part of their training programme), skipping any section of training is permitted, but can he appear on KBC?

I'll be highly obliged if u can throw light on this issue.

Praveen! There is no such specific rule either prohibiting or allowing such IAS to take part in TV Show during the period of probation but it shall be in the interest of your brother to specifically seek permission of the higher authorities so as to avoid any future complication.

He asked for permission earlier, but he was denied orally. He didn't go for written application. It is allowed to exempt particular sections of the training, but there are some provisions written in All India Services(Conduct)Rules, 1968. which state that

"no member of the Service shall except, with the previous sanction of the Government -
(f) Participate in, or associate himself in any manner, in the making of:—
(i) a sponsored media (including radio, television programme, or
(ii) a media programme commissioned by Government media, but produced by an outside agency, or
(iii) a privately produced radio or television or other media programme including a video magazine.
Provided that no previous permission shall be necessary in the case a member of the service participates in a programme produced by the Doordarshan on a subject dealt with by him in his official capacity.

I couldn't understand what it means.
I would be highly obliged.

Your brother may go through Rule 6 of the All India Services Conduct Rules 1968 pertaining to the Connection with press or radio and act accordingly.

The simple meaning of the provision to which you want to understand is that a IAS in his official capacity can take part in a programme if is being telecasted by Doordarshan. Official capacity further means suppose he is holding director animal husbandry or any other department and discussion over his holding department has to take place then he can take part even without getting prior sanction.

In my views, he cannot be barred from taking part in the KBC program, as that would only tend to showcasing his mental abilities and knowledge base, not to represent the department for official purposes.

*Respected Dhingra G! Pardon me for disagreeing me to your views on this point. As per rule position cited by querist, such person can take part only for official duty without specific permission otherwise he requires due permission which has already been denied to him so he cannot take part now.

Dear Raj ji,

When the querist states, "he didn't go for written application," I wonder to know that an officer of the status of IAS prefers to seek permission informally, instead of in writing, when he has to be saddled with the responsibility of implementation of the prescribed rules, regulations and procedures in the offices of the Government of India and States. H eis not expected to work informally.

Verbal request and verbal permission have no relevance in government business. He has to apply for permission in writing, which he is likely to get, as hos participation cannot put any hinderance in his official duties and responsibilities, he being still under training during probation period.

If you go through my earlier post again, I have expressed my views with reason, why he cannot be barred from taking part in KBC, as the rule clearly suggests for his taking part with due permission. But his application should be put on record, not as of a verbal discussion.

Nothing informal can work in Government offices, if he has to become a law abiding officer of the Government of India.
