Mutation

Hello,

I am from punjab.

My father bought plot in punjab and done registry of plot.Ever since we dont know about mutation so this time when we went to sell that plot people said that you cant sell this property without mutation.
After that we went to PATWARI and he told us you cant get yours Mutation now.
We have done every thing to get ours mutation done but we got nothing.
People are asking for lakhs to get our mutation done.
Main problem is that they are saying that you cant get mutation because land area is finished because the person also sold roads and all.
Please help us tell us what to do.

If the seller has no area in the revenue record as on day, you cannot get it done as truly opined by people but if the situation is otherwise then contact Tehsildar and get it done.

Sir we also went to tehsildaar he told us the same thing that i mentioned earlier that its very diificult but after some time he started saying that you can get by alternate methods but he dist say anything to us.
Sir please tell me the way by which we can get ours mutation.
Sir the plot is on the name of my fathers only and it is located inside the colony.
there should be some way by which we could get it or unless people will give us very little money or no money.
Sir could we go towards court and we would do after going to court?
Sir, the problem us he sold property to so many people and many of people got there mutations done.but we didt know any thing thats why we didt do that.

Please show us way.

If the portion sold to you is genuine property then mutation can not be refused.
File Writ petition in the high court if the authority continue to refuse mutating the land in your name.

The mutation should be got registered within a period of 12 years of the registration of sale deed. Anyway, you move an application before Tehsildar praying therein to sanction the mutation and if he declines then file its appeal before collector and then Commissioner and then FC and then to High Court.

I will keep in touch with you while going to take our steps.
I want to know that these petitions in court does take time and do we need to have any Lawyer.
And sir how much money it takes to have our petitions in courts.

The fees differs from state to state , advocate to advocate.

Not only time but expertise is also required in such matters so better to engage a lawyer whose fee shall differ from persona to person and place to place.
