Payment for recontruction

HELLO EXPERTS I HAVE A QUERY

that my aunt has purchased a property which needs some repairs , as she is not able to manage the workers for repairs she gave amount to a person who promised to make repairs including some construction part that he accepted he will do as per her specifications while work is going on

but he did only 10 to 15 percent of the amount of work and he frightened her , and the work was not at all did ever proper plastering was not done

she has given such amount without any agreement, part of amount in cassh and part of amount in cheque, is it possible to file case on him, it happened before 9 months

Cheque payment and physical presence of contractor is sufficient to be possible to file case on him

thank you sir, but remaining part of the amount was paid in cash for that amount can she claim, is there any time period, for filing the case
