No he is not eligible

Yes!If any other arrangement had been made for Payment of gratuity with any of the funds management system and it was more advantageous to them as contemplated under section 4(5) of the Payment of gratuity Act.

(5) Nothing in this section shall affect the right of an employee to receive better terms of gratuity under any award or agreement or contract with the employer.
