Re: maintanance allowance to wife after divorce by mutual consent

(Querist) 13 July 2012 This query is : Resolved
Respected Sir,
I am registered with you at this mail id kghosh47@yahoo.com
In case of divorce by mutual consent if the girl is a working lady whether it is mandatory for the boy to pay maintenance allowance to his wife and if so to pay at what rate. Also whether this maintenance charge has to be paid on monthly basis OR has to be compulsorily paid on one time lump sum (alimony)basis. The couple has no child
Devajyoti Barman (Expert) 13 July 2012
The mutual divorce is nothing but an agreement among two couple going separate directions.
So on whatever they agree they could put that in writing.
Since it is a one time settlement . permanent alimony could be decided t be paid even if the wife is working.

in consentterms specifically mention that since wife is working she wont be claiming any maintenance . dont agree for maintenance in consent terms

similarly dont agree for one time payment . if at all you have to pay do it monthly till she remarries . wwhat may happen is after getting lumpsum from you she may remarry . you lose your money and wife both
