Regarding notice period and right of tenant

hello...
I am student and living in delhi in rented house since 2 years with without rent agreement (but i have paid rent in sometimes cheque/ bank deposit receipt). before 10 days my landlord told me to vacat house within 10 days because it is sold. i told him ok i am searching house then i will vacant..but 10 days passed and i m unable to search house...and i have information and prove that building is not sold. i requested him to give me some more time to find the room...but now they r telling that u vacant the room today otherwise u have to pay double rent from tomorrow whereas they have increase rent in Feburary 2012. Please tell me what should i do and what is the legal action against landlord...is there not any law regarding notice period and increase in rent.....waiting for ur reply.........................Sir, My rent is Rs.3400/month...now they r demanding that Rs.6000/month till i vacant the room...otherwise u vacant today. Secondly what is TPA in the above....in absence of a written lease agreement you can be served a 106 TPA notice asking you to vacate within 15 days....As i have information notice period is 3 months is it not true... ..waiting for ur reply...

We'd have to see whether your tenancy is a protected tenancy or a regular tenancy ? if the rent each month is less than 3,500 then in that case yours is a protected tenancy and the landlord cannot oust you unless he proves specific grounds such as non payment of rent (agreed rent) or bona fide requirement etc. It's a long drawn process.

As per the Delhi Rent Control Act the lawful increase in rent is 10 % every three years and not more than that.

Secondly if the rent each month is above 3.5 then there is no protection as such and in absence of a written lease agreement you can be served a 106 TPA notice asking you to vacate within 15 days. Failing which a suit can be filed in court for your eviction. Which again would take some time.

Sir, My rent is Rs.3400/month...now they r demanding that Rs.6000/month till i vacant the room...otherwise u vacant today. don't vacate and don't pay increased rent. Keep paying existing rent regularly. If the landlord does not accept it, deposit the same in court as per procedure prescribed. If the landlord gets nasty, report it to Police in writing. if you can afford, engage a lawyer and file a suit for injunction.

Mr.Harbhajan singh guide you well.
Dont worry, if your landlord threat you then immediately call the police and police will handle your landlord itself. It is better to hire an advocate and file case, then your landlord will not be able to evict you for years. but you should have proof that you are paying rent regularly.
