Hi, I have booked 1 BHK flat at Daange chowk, chinchwad, Pune. the agreement cost of flat is Rs 1150000. and the deal was committed for Rs 1600000. Now after paying 1100000 and passing 8 months. Builder wants to cancel the deal and wanted to give us money back whenever possible for him.... the current cost of the flat is Rs 2000000. We have only made a legal agreement as of now and no other documentation done. Please advice how i can deal in this situation... Thanks
Amit

The legal agreement means is it regd., agreement of sale? If it is so then issue legal notice to the builder to execute the regd., sale deed, if failed then file a suit for specific performance of contract. Averment in the notice is very iportant for this you contact your lawyer.

Dear Querist,
Since there was a contract (agreement - registered or unregistered) - which is being violated - in light of escalation of prices. Without further delay - send him a legal notice right away through your lawyer and then follow up with a suit if necessary to reap the rightful benefits of prudent investment.
Feel free to talk !
