WHAT IS THE RULE IF A A PERSON IS DIED OR INJURED OWING TO ACIDENT REGARDING FILING OF CLAIM.WHO WILL FILE CLAIM? PERSONS LR IF DONT TURN UP DUE TO BEING AWAY FROM INDIA THEN CAN OFFICE-IN-CHARGE WHO SUBMIT REPORT U/S 158(6) IS TO BE DEEMED TO BE CLAIM PETITION OR SOME OTHER PROCEDURE.
IN OTHER WORD WHAT IS TREATED AS CLAIM PETITION AND BY WHOM?

If the victim is dead, only his or her legal heirs can file claim application before the MV Tribunal.If the victim is injured then he only or any person duly authorized by him through a POA can file the claim application. If the LRs are abroad, they may authorize a person in India to file the claim application on their behalf.
