False implication in electricity theft case

Dear Sir,

My brother(not the landowner i.e. Daddy) had setup a factory and taken a electricity connection from MSEB in his name. Due to market condition and later due to his major accident (He got mentally disturbed )he closed down this factory in 1996. He got a bill of around 60000 without proper details in the last bill. This was brought to the notice of the authorities but they insisted on paying 1st. We did not pay. The meter was finally disconnected.

A new electric meter was installed in Daddy's name and continue to pay regular payments for last 15 years w/o fail.

My brother was under medication for almost 5-7 years and now he is quite ok but never have taken up factory work since then.

Now after almost 16 years the authorities are pursuing the case without giving written explaination. They have threatened him to take police action against him if we do not pay the o/s money. We have taken all the details and also tried getting the details of billing but in vain.

Please help me what should I do legally?

Are they right in doing so without giving any notice?

if wrong bill of rs 60000 was raised in 1996 you should have moved the consumer forum for deficency in service . or you could have challenged the notice of demand and disconection by writ . for 16 years you slept over the issue . the dispute could have been refreed to electricity inspector to determine whether meter was faulty and he could have determined amount of nergy supplied to consumer .

sice you ahve failed to be vigilant you are bound to pay the bill now

First check whether any Electricity case has been initiated against you or not.
If yes then act seriously as it is a Sessions triable case and taking bail on payment of Billing amount with pilferage charges, if any ,is the only option.

The challenge the case either in quashing or in trial.

But their is no demand / legal notice from them in any form even 16 years ago nor now. It is just they are coming and harrassing us to pay. I checked online this meter is not displayed anywhere.
