Bc certificate validity for govt job in punjab

SIR ,I M A TEACHER IN PRIVATE SCHOOL.DURING MY CERTIFICATE VERIFICATION FOR GOVT. TEACHER POST IN PUNJAB I SHOWED THEM BACKWARD CLASS CERTIFICATE DATED 9SEP 2009 AND 8 AUG 2011.BUT THEY REJECTED THAT AND SAID THAT ONLY THOSE CERTIFICATES ARE VALID WHICH ARE 1 YEAR OLD FROM THE DATE OF APPLICATION OF GOVT JOB(I.E; BEFORE 1 JUNE 2011,THAT WAS THE LAST DATE FOR APPLICATION).WHAT SHOULD I DO

Make a representation and sent the same form through registered post stating therein that the caste has not changed within the period mentioned above and a fresh certificate can also be submitted at the time of interview if the same is necessary. You shall file a writ petition before high court without much delay.

I think this was unreasonable discrimination...

serve a legal notice/ representation upon the concerned department as soon as possible.

also find out the relevant rules applicable for the said purpose.

if the discrimination is removed then approach the Hon'ble Punjab and Haryana High Court at Chandigarh by way of Civil Writ Petition.

I am sorry to disargee with Mr Prabhakar singh and Mr Makkar and Mr Kiran Kumar,.


it is not SC or ST certificate it is OBC certificate. For OBC mere happening to the said communicty does not make one entitled for reservation. he also has to be below creamy layer. The creamy layer status keep changing. The decision of the authorities does not appear to be harsh.

If the caste certificate was not being accepted and last date was fast approaching then nothing rpevented him to appear and general candidate and in the menawhile if his OBC certificate is renewwed he could have attempted to get the reservation.

I feel he has not yet lost limitation but non-filling of form has rendered him out of race.

The querist has not put before us the matter of creamy layer rather a simple matter of non reliance of the backward class certificate is mentioned.

It seems that Sudhir Kumar has persumed the facts of the matter just to show the reply in other-side.

I stand over my reply given facts by querist.

I endorse the advice of Shri Raj Kumar makkad. The reason quoted by the authorities does not seem to be valid. Moreover, had the querist been falling within the category of creamy layer, he would not have been able to get an OBC certificate again on 8 Aug. 2011. Moreover, if querist was able to get OBC certificate within about 2 months of the date of application, he was still an OBC candidate to be eligible for the post against the reserved category.

It is unfortunate that this candidate remained out of the race. Had he been applied even as a general candidate it could have been easier for him to stake his claim on OBC post which perhaps has been worngly denied to him.
