Retirement benefits-encashment of leaves

(Querist) 21 April 2012 This query is : Resolved
I have retired on 31st March, 2012 from a public sector company under Control of Ministry of Commerce. Under I.T. Act Section 10(10AA)(i) payment of encashment of leave is fully exempted from tax in case of government employees. In case of non government employees payment beyond Rs.3 lakhs is taxable which means there is limit of Rs.3 lakhs under section10(10aa)(ii).
Kindly advise whether the employees of public sector companies under Control of Govt. Ministries are covered under the above stated section i.e. 10(10aa)(i)or not for payment of leave encashment at the time of superannuation.
Best Regards
