Share transfer in flat

(Querist) 20 April 2012 This query is : Resolved 
Sir, I own flat jointly with my father (second holder) & sister (third holder). My father had contributed 50% for the said flat and for balance amount I had taken a housing loan from nationalized bank. My father & sister are also co-borrowers in loan agreement as bank had insisted their name to put though they were non-earning members of the family. Now, my father is died without leaving behind a WILL. Please let me know what are the documents required to be submitted to the Society to claim the share of my demised father in existing flat to transfer in my name or my sister’s name? Being my name is first in flat, I only have a right to make a nomination with the Society and accordingly I had nominated my younger sister’s name.

it's depend on Bye-law or rules of the society.

you have to make application to society for transfer of 30 %share in flat of your father . you have not mentioned whether he has left any nomination or not .

if no nomination then society may not transfer share in flat unless you give succession certificate .
