Internet hacking of money due to inalert security system of icici bank

My son has a S.B A/C at ICICI Bank,Hyderabad.Recently he has been duped to the tune of Rs 50000 due to complete inalert Security System of the Bank through net banking(More precisely Inter Bank Mobile Payment System).Actually he has never opted for IMPS,not at all conversant with it.Now the Bank has confirmed deactivation of IMPS from his A/C.When he has not at all opted for this service how can bank do it now,WHEN the damage has already been done.I have got only viewing facilities(no transaction right) at SBI Internet Banking which means that if somebody transfers some money from my A/C electronically it will be bank's responsibility.As per consumer Protection Act,1986,Banking Services also come under this.Bank is simply passing the buck to Police Dept to whom we have already filed an FIR.Bank has not given us the Beneficiary details eg Bank Name ,Branch Name/Code of the Branch ,A/C No where the money has been credited.Even if this is internet hacking there is inter state network for detecting the offenders.We are demanding refund of money from the bank ,as its system has pampered transfer of money from an unregistered A/C in the sense that IMPS service was not AT ALL OPTED for which as per RBI bilateral contract between customer and bank is necessary.MOREOVER RBI REGULATION SAYS that to avoid unnecessary hacking like this Banks must take proper measures like insurance etc.PLEASE ADVISE

The duty of the Police is to nab the culprit whereas the duty of the Bank is to protect the customers from any fraud.

If in this case the Bank is found to be deficient to protect the interest of the customer in a proper manner then the Bank definitely comes under the provision of deficiency of service as provided for under the Act.
However every fraud does not make the Bank liable for compensation if it is found that it has taken enough protective measure.

Actually ICICI BANK has a very effective internet banking security system.Even before you enter the transaction password,you will be asked to enter a onetime password,which is generated by the customer.Every advancement in technology has more loopholes than the advantages.We have to be extra careful before logging out.Hackers are more vigilant than us.

You can complain to the banking ambudsman with your query.At Hyderabad the Office is located in the Reserve Bank of India premesis,saifabad.You can locate the telephone numbers and official mail ids on the web.

You can lodge an FIR to the Cyber Crime Branch to the Police as per provision of sec.66 of the Information Technology Act.You can also send a complaint to the Banking Ombudsman and file a case in Consumer Forum against the Bank for deficiency of service.

Lots of Complains and cases.
Hardly anyone could recover lost money.

They operate from foreign country internet, c wireless network , laptop & untraceable. May be in yatch.

Bank justify their act, as official instn from client in usual, normal business practice, so no negligence. Hackers are smarter.

Cyber crime going to be more dangerous.

Lodge a complaint by making bank party to it.

It is difficult to get back the money, but not impossible.
