Advocate act

(Querist) 06 April 2012 This query is : Resolved
hello
i m not getting the answer for under what circumstances an advocate may refuse to appear on behalf of the party?
so plz any one help me.

if you have filed your vakalatnama you are bound to appear .

if cleint has failed to furnish instructions you can apply for discharge .

but after having filed your appearance and having taken fees you refuse to appear your cleint can complain to bar council against you.

Want of instructions & co-operation of client can result into it, but in that case Adv must issue prior notice to his client, and Court, his intention to withdraw his VP.

Dear Amy
there is a relationship between Client and advocate, if the relationship is not good between them they never win a case, the advocate can not appear before the court on behalf of the party due to the relationship.
for example: non-payment of fee, client is not ready to follow the instruction, etc.
feel free to call

Usually UNPAID Fees, but he cannot say so..
So he will find legal excuse, Not to do job, as well as protect himself from Disciplinary action by Bar Council.
Or as a result, client loose his case...

If the client do not contact you and keep away from you without instructions, also not making payment of agreed fees, then you may issue notice to the client and then inform the Court as "no instructions" and withdraw from vakalath
