Dear Sir
We have executed agreement with our builder in 2009 for redevelopment of our property. Due to some reason ( our tenant had dispute with Builder hence they were not willing to vacate their rooms.My query is that we got 1st installment in 2009 Second installment was due in the month of May 2010 but he has not given us . Can we make another agreement for revised installment amount? because the rate of property has increased . Our property is situated in Maharashtra . Thane. Please advise.

You can terminate the current agreement for violation of terms and condition by not paying the amount as agreed.

You can execute a new agreement with regards to the property.

what were the terms of agreement ? was it a condition precedent that tenants will first vacate rooms then only will installments be paid .

if you have failed to give vacant posession dont blame the builder
