(Querist) 28 February 2012 This query is : Resolved
Dear Sir,
Kindly please anyone can help me, currently i am residing in a flat which belonged to my grandfather after he died it was under my grandmothers name and after she expired she had given it her 2 spinster daughter so the flat was under the owner ship of them We also with my father were staying with them and taking care My grandmother had made a will in which she had given equal shares to all her 4 children ie 2 sons and 2 daughter as mentioned above the elder son of her was not staying with us.as even my both aunt and my father are no more and i am staying with my Mother/wife and elder sister. My uncle had sent a summon asking for the 50 % share in the property. The summon documents were left at the door of our house and none of the document is signed by him. Also there is a family memorandum in which all of them have taken a equal amount of share from my grandmother some property and that was in lieu given to him instead of the 1/4th share what my uncle was suppose to get.
Currently I am not financial so strong to go for the court case. Can anyone of you guide me please and suggest as what needs to be done.

You shall have to engage a lawyer otherwise it shall become vey difficult for you to persue your case.

If your income is below Rs. 1.5 lakh per year or you belong to SC/ST category then you can move an application before Legal Services Authority and you shall be provided free legal aid which includes a lawyer and all legal expenses meant for the litigation. You should avail this facility immediately and should come present before the court on the day indicated in the notice otherwise ex-parte case shall be decided against you and in favour of your uncle.

Take your action immediately. There is no requirement of the signature of your uncle on the notice. The signature of the court at made on notice and not of the party concerned.
