Poa for nri

Hello, i and my husband are NRIs and we want to buy residential plot/site in india. My husband's father (my father -in-law)has my husband's Power of attorney done 10 years back in india when my husband was still in India as a Indian resident. Is that still valid to buy property as an NRI? We both are Indian citizens living in abroad.

It can be used, however, it is advisable to execute a fresh POA for purchasing the property.

Thanks for the reply. I read somewhere that the Power of attorney has to be signed in front of the consulate officer of the Indian Embassy of the city and country where you are located. Is that required only if a new POA has to be done ? And, can we ignore this rule if the POA done was even before my husband left India or became NRI ?

Yes it is bteer to execute a fresh one.
The POA needs to be signed in abroad, countersigned by the Indian Consulate Office and attested by the Notary there.
In India the same document then needs to be Adjudicated from the local Collectorate.
