Rent control act

1) Is Rajasthan rent control act is applicable on Lease also?

2) Can we increase rent comparison to Max. rent mentioned in rent control act (5% yearly) or period in lease agreement (Means can we mention the rent extent period is 3 years, not on yearly basis) as per rent control act?

Yes. Rent Control Act is applicable for lease therein so you can adopt the second option.

The Act provisions cited by you appear to be similar to the Maharashtra Rent Control Act. The Act applies to leases. You can provide in the agreement for yearly increment as provided in the Act or opt for a fixed monthly rent without annual increases for the entire period of lease. Claiming of nnual increase is optional for the parties.

Raj rent contol act is applicable in specified cities only and at all other places TP act is applicable so where your property is located.

Dear Mr. JSDN, will you pl elaborate? This seems to be a very peculiar situation. As far as I know, the rent control legislation is made applicable to all parts of a State in other places, as the objective is to protect the interests of tenants.

JSDN! The question was whether Rent Control Act is applicable in Rajasthan or not so my reply that it is applicable is not wrong though TP act is also applicable.
