Loan with a bank

Dear Brothers,

Please clarify:
A bank is claiming from a client that an amount of loan was credited in to his account and there is some debits also from that account towards the instalments, as claimed by the Bank. But the client is confirming that he has not executed any document like pronote, agreement and any cheque or ECS authority given to the Bank.

In this issue how can the client's right be protected?

The easiest way to save his balance money is to withdraw everything from the Bank.

If the customer is indeed has not borrowed any loan nor any instructions for ' auto debit' is given to the bank, this action on the part of the bank amount to grave deficiency of service for which you can file a case for compensation and damages in the Consumer Forum.

However the customer without withdrawing the money can file a case in the Consumer Forum and ask for injunctions against any future debits from his account.

It is unauthorized act of the Banker,may be intended to keep limitation running and extending all the time so it is better to write them raising it as issue and objection without delay and all balance money should be withdrawn.The relevant objections before RBI & ombudsmen should also be raised.

File a suit in a civil court & if U R a customer of the bank U may approach the Consumer court.

appropriate solutions are given by Mr.Barman and Mr.Prabhakar.
I would suggest to act as advised by Mr. Prabhakar first and if there is no result, then you can go ahead with the consumenr complaint.

Yes but the prolem I have seen is the Ombudsman hardly gives relief.
