Date of birth certificate

My friend sister daughter born at home and she didnt took a treatment in any hospital as her husband didnt provide that her daughter born in surat at home after the birth of her baby some dispute arises at her matrimonial home as her husband and her in-laws wants son not daughter so she came to her paternal home and since then till today she is livining at her paternal home no body asked to her from her matrimonial home three years hasb een passed she dont have a birth certificate of her baby now her daughter reach to the age of 3 years and for her admission in school birth certificate will require which she dont have now what remedy is there for such problem

So far as birth certificate is concerned, an application can be got moved to the Registrar of Birth and Death of the area wherein the girl was born with an affidavit intimating the true situation and reasons for non-recording of the name of that girl child and her name can be got entered as per procedure with late fees.

So far as matrimonial dispute is concerned, daughter of your friend sister have various recourse available like filing DV case, 125 Cr. PC, 498a IPC etc. She may file all at same time. Advise them to take help of local lawyer.

I do agree with Raj Kumar saheb
for other marital problems she can get relief from CrPc as well as family court. the father is lawfully bound ot give alimony/ maintenence for wife and daughter as well
