Dear Sir,

I want to know where is applicable BOCW Act-1996. I am working in Power Plant which is under Construction.

If u have taken licence under Factories Act, 1948 & manufacturing process has already started than BOCW Act 1996 will be not applicable for your power industry & so far applicability of factories act sec 6 & 7 of factories act is required for the applicabilty of factories act with rule of respective state.

So if your industries is registered under factories with fulfilling of sec 6 & 7 than you have not to worry about BOCW Act

Look for the date of implementation of BOCW Act and the Cess Act in your State. If the construction of your factory fell in that period; you are covered under the BOCW Act and the Cess Act from that date.
