Status of nominee of bank locker

Querist : Anonymous (Querist) 23 November 2011 This query is : Resolved
Dear Experts,

I am the nominee of my deceased mother's bank locker. After my mother's death, I approached bank to operate the locker but bankers demanding legalheir cerfiticate.

After producing the legalheir certificate, the bankers now insisting me to produce no objection letter from other legal heirs to operate the locker.

Please clarify whether banker's stand is correct or not

yes, it is normal procedure to access, that is one of the RBI condition.

Please recheck the position whether you were appointed nominee only for SB account of the deceased, or for the locker also? If there is no nomination for locker in that case you will have to produce legal hiership certificate also.

if you are nominee then you can operate the locker without other formality.if not then you have to follow bank procedure.first of all you have to check the bank document where the nominee name's mention.

You have not mentioned the name of the Bank.

Almost all have their rules a bit different about lockers.

Visit the web site of the Bank first then revert back with questions.

However you must know that as nominee you have limited right as trustee simply. You do need it to get it distributed among all heirs. The heirs must have moved some application in this regard to the Bank is my guess, that is why Bank is stating so.
What is bad in giving NOC demanded ???
