Partition suit in annecestral property.

in partition suit, our prayer is only for partition and devide for agriculture land then valuation of the property is required? or suit valuation is barred for jurisdiction? or in partition suit pecunary jurisdiction decide the courts jurisdiction?

There is alwasy minim cf fee for partitoon suit. In kanranataka it is Rs.200/- whatever the valuation of the suit.

The jurisdiction of court is decided based on two factors with regard to property:

a)The property should situate within territorial jurisdiction of the court;

b)The valuation of the property must be within prefixed pecuniary limits of the court.

You need to value the suit only not the value of the property.
In WB there is fixed court fees for partition suit as a result of which one may value the suit anything withing Rs 1,50,000/- which is the pecuniary jurisdiction of the lower court.

this is not the partition suit but it is is application for partition of property and only Rs 10/- court fee is required in haryana when it is filed in the office of the Assistant Collector IInd Grade and if filed in the civil court than it is Rs 50/- + 50/- only.
