Under the provisions of ESI Act, if the employer provides better facilities than what is envisaged under the act ie. substantially similar or superior benefits, the employer need not get covered under the Act.

Is the PE still required to obtain the exemption under ESI Act.

Yes, even if the employer provides better facilities, but he has to still make an application to the department for declaration of exemption of the establishment under this act.

yes Mr. vishal is right. you still need an exemption under the act and your employees must consent in writing that they have been provided better facilities than the ESIC.
