Maintenance under section 125 and section 24

Dear Experts

My wife is more qualified than me and is earning well.
Is she entitled for interim maintenance & full maintenance under Section 125 and Section 24?

I am already paying Rs 5000 per month into my wife's account for the child besides paying a LIC premium of Rs 2000 for the child.

Kindly confirm?

It will depend upon your status in the society, your living standards, since your wife is entitled to the same status and living standards. Therefore, whether or not she is entitled to any interim maintenance or final maintenance will depend upon all these factors, her earnings etc.

You can file a petition u/sec.127 Cr.P.C.in District judges Court for alteration of maintenance allowance.

Its a complex problem but why are you shooting us with same query time and again.

If you are able to show that she has means more than you which is sufficient for her even above your standard she would not get.

Only proof of income of your wife can help you rather than fighting the case on hypothetical grounds, may she be more qualified than you.

Your wife is not entitled to get maintenance from you. But quantum of maintenance to your child may be fixed after considering the income and social status of both of you.
