By mistake one of the respondent's name was included instead of other name.Notice served.Prayer against his registration.whether is it better to amend or withdraw the writ and file a fresh?
Kiran Kumar (Expert) 17 September 2011
you need not to withdraw a fresh writ, file an application for amendment.

but if there are certain major faults committed due to wrong impleadment of a particular party then you may withdraw the writ but simultaneously seek liberty from the court to file a fresh one with better particulars.
Devajyoti Barman (Expert) 17 September 2011
Yes, no need of withdrawal.
Even the verbal submission to the court may give you the liberty to make the necessary corrections in the writ petition and the copies to be sent.
Raj Kumar Makkad (Expert) 17 September 2011
It should be got amended as there is procedure available to deal with such situation.

Amendment would be best course not the withdrawal.
Shailesh Kr. Shah (Expert) 18 September 2011
here is a provision to amendment, so amendment would be better.
