My Mother had issued a POA - to my uncle in 1989. The POA is not registered but it is attested by executive magistrate. Now my uncle has sold the property to his own wife and sons @ 98% less price than the market stamp duty rate also. Also the property was governed by a partnership firm with six partners. Only my mother and one more woman are the ladies partners and only they are together on my side. What should i do. What is the Value of POA which is not registered and is it admissable in court as evidence.

The sale deed was registered somewhere in 2008. There was a prior development agreement registered with the same party i.e. their sons and wife in 2005.

You are not able to come out with complete facts. You would be better advised to personally visit a lawyer, show your papers, discuss and take his advice and proceed further.

In he given facts (incomplete), you are advised to immediately send a notice to your uncle to cancel the alleged POA and then file a civil suit seeking declaration of sale-deed as null and void as neither authority to sale was given nor your mother ever received the consideration of alleged sale.

Facts are not clear. Better you consult a local lawyer . However , You have mentioned that property has been sold by the POA holder to his family consequent to an agreement in 2005. It seems all six partners have agreed to sell it. Experts have rightly opined. You can file civil suit as advised by the expert Shailesh Kr Shah for cancellation of sale deed with the help of other partner
