Not using property more than 6 months

i am land lord in mumbai my PAGDI OWNER is not using property for more than 6 months /have filed a case in small cause court mumbai /he is claiming he uses his as a godown by false goods entries /in what way can i prove in court that he is not using the premises /i have taken electricity meter reading his average comes about 15 to 20 units per month what else can i furnish as concreate proof to honourable court

You can get appointed a local commission through court as well as can produce oral evidence from locality.

It is very hard to prove the non occupancy of the tenant.

That too when the tenant uses it for godown, the tenant's statement may be accepted by the court.
