retirement benefits

(Querist) 30 March 2009 This query is : Resolved 
one of my colleague is retiring and is of age of 65yrs. he has worked for continous 40yrs with dedication and sincerity and has never got any thing other than monthly salary.His current salary is Rs 6000/- The company has earned handsome and has good corpus and paying ability but is desiring to underpay his retirement dues. pls advice by calculations if possible the maximum best retirement package he can claim rightfully and statutorily.

I am sorry, legally, your frined is not entitiled to any retiral beniftis under any labour law. Your friend should informally approach the employer to remind him how he helped the organisation to flourish and he deserves some appreciations

Mr. Mohammed this is the position with ur friend and that will remain...no law available to support him on the basis of sympathy alone.

Think this is an informal employment without mention of term and condition of employment. If there is no deduction of PF or Superannuation or fcontribution for family pension, and deposited as requried by law, these things not be given, moreover you are saying he is retiring at 65 years.
