Can i Apply for divorce

hi, i am private employee and i married a girl working as HR for reputed company.after my marriage March 28,2008 she stay at my home till November 1,2008. Then without reason she left to her home.Every Month she go to her home for a week and she returns.i thought same but later situation change.Her father and mother approach 3rd party members and make a mess that my parents are harassing their daughter.Now March 29,2009.She going to her job and no contacts between each other.Couple of meets between myself and thier parents..but things are not resolving.Now iam not interest to contine family with her. can i apply for divorce? if yes how can i start my process

To apply for divorce, minimum one year to be awaited, after marriage.

That was also over.

you need to meet your wife in person and try to resolve the problem.

if not, you both consult the doctor or psychiatrist or psychologist or your elders to resolve the problem through counselling.

even it fails, you can approch the court.

You may apply for divorce by filing a petition for divorce, provided you feel that there is no possibility of any amicable settlement. You have to make precise allegations which constitute cruelty and perhaps desertion. You may not be able to get divorce on the ground of desertion right now but it also amounts to cruelty due to denial of marital pleasure.

i do agree with BBR Goud but no need wait for 1 year to elapse, you can file application reagrding this along with the petition, if you both are Hindus, any way waht is your religion? (dont feel bad there is no uniform civil code in India)

Mandatory one year period from the marriage has already been elapsed.
But you should go for the reconciliation proceedings first.
