(Querist) 15 July 2011 This query is : Resolved
Mr A , accused in 498A, 406 declared Proclaimed Offender. Trial also running for Divorce in another court. Can Mr A still contest the matter? Is there any limitation on any lawyer appearing for him?
Advocate. Arunagiri (Expert) 15 July 2011
A proclaimed offender has to surrender before the trial court and can seek for bail.

He can take the help of an advocate.

1ST LY YES HE CAN CONTEST THE CASE BUT HE WOULD NEED TO SURRENDER BEFORE THE TRIAL COURT ALONG WITH OR WITH OUT AN ORDER OF ANTICIPATORY BAIL OF HIM ISSUED BY THE Ld SEASON JUDGE OR HON'BLE HIGH COURT. IN ALMOST ALL CRIMINAL CASE THE OFFENDER 1STLY NEEDS TO SURRENDER AND TAKE BAIL
Arun Kumar Bhagat (Expert) 21 July 2011
A proclaimed offender can be arrested by any person so it would be very risky for him to appear in Divorce case. The Complainant can by using force take him to the concerned court or nearest police station.
