gift of plot

hello friends,

i need your help in the following case:

one of my client owns 3 different plots of land amounting to one big piece of plot. now she wants to gift 50% of the total plot to one of her sons. how can this be done? since she had bought the same from 3 different people there are 3 different 7/12 extracts for all the 3 plots in her name. which is the best and most secure method of gifting out the same without any legal problems in the future. kindly help reg the procedure to be followed reg the same.

She can execute a gift deed and get it registered. The question is about how to demarcate 50% and how to effect mutation. This can be done with the help of measurement and fixation of the boundaries of the 50% portion. Thereafter there should not be any problem unless the gift is hit by provisions of any law that prevents fragmentation.

Yes if she execute a registered gift deed in favour of her son. once she has purchased the land and been in the peaceful possession and enjoyment of the same, she can dispose of the same however she wants.

thanx alot. i am already processing the gift deed and v hv also decided to get it registered. is it posiible that after registration of the gift deed, v can get 2 7/12 extracts 1 each in the name of the mother and son? any idea if there is any prevalent law which prohibits fragmentation on NA plot? pl advice

by making a regd, gift deed in the name of her son and after entering his sons name property can be demarked by giving an appliction to city survey officer
