Yes I agree with Kiran. Some times police will release the accused by taking a surety in bailable offences and after filing the charge sheet accused will have to take bail from the court.
prashant pundhir (Expert) 17 April 2011
Yes,Police have no right to give the bail .

Agreeing with the opinion of Kiran, I add that in some petty matters in some Central rules States like Delhi etc. police takes surity like bail from accused but in those states also, bail is to be ratified by concerned court.

if the police officer grants bail by taking the surety in this regard and after that the challan is filed in such case and then the accused is required to take the bail again.
Naresh Kudal (Expert) 18 April 2011
bail taken by police officer is for your appearance before the court on the date of hearing. on the date fixed you need to present before the court.
Arun Kumar Bhagat (Expert) 22 April 2011
Bail is given by the Police in bailable offence on execution of bond of appearance by the accused & giving undertaking that he shall appear before the area magistrate and obtain court-bail on the date specified by the Police. Police officer can give bail. I differ from all earlier views.
