RIGHTS OF DELHI JAL SADAN MAGISTRATE

The Delhi Jal Board officials are not disconnecting an unauthorised connection in the extended portion of my dda flat. They say they they have issued a challan and DJB magistrate will order the disconnection of that unauthorised connection. I personally met the MAgistrate and he refused to accept any such application from my side stating that his duty is only fining the culprits for the challan issued. He said that it is the duty and right of DJB officials to disconnect the unauthorized connection. Even senior DJB officals say the Magistrate will decide about it. Can guide me regarding the rights of DJB Magistrate. Where can I find the rights and regulations for disconnection of DJB. In my reply to RTI DJB officials say it depends on the merit of the case.

This query is related to another Query posted by Sudha Makol in regard to electricity connection.
I distinctly remember you posted the same query some months back. Again you are posting the same query.
In any case, forget about water connection. Please indicate whether there is any constructed portion on your roof or not?
If available, did you make any formal complaint to the DDA/MCD and ask for its demolision? IF NOT WHY NOT.
If you have made a formal complaint and if DDA/MCD had not taken any action, then file a writ petition before the HC for appropriate direction to the DDA/MCD for demolition of the unauthorised construction. Such demolitions are taking place in Delhi, which you are quite aware. Once the construction goes, the question of granting any water connection would not arise. It is not for Jal Board to find out whether the construction is authorised or unauthorised before giving the connection.
