let me know if any person is proclamation

(Querist) 30 March 2011 This query is : Resolved 
that i had lodged one complaint under 138 negotiable instrument act the accused were unable to appear in the court after the log time the court had declare him as proclamation as the accused had taken voluntarily retirement and i had came to know than i had send the order copy of proclamation to his department and asked not to pay him the pension until he appear before the honorable court from where he was proclamation but the department had refused to stop his pension know kindly guide what action is to be taken against said department

Then you apply for attachment of his properties by the court.

no action can be taken by you against that department.why they'll stop pension? why they'll accept paper send by you? why they'll rely you? court has not send any order to stop the pension.so there is no question of taking any action simply on the basis of papers send by you.

You cannot take any action against the conderned department on account of your personal case against any of its employee.

Your approach to the department was not correct. Any Government department is not bound to adhere to the instructions of any third pary individual against the provisions of set rules of the Government of India or the State to which the employee belongs.

Moreover, pension cannot be stopped in any case unless in any departmental inquiry for any serious indiscipline in office the employee would have been awarded with a penalty of stoppage or reduction of any part of pension that too for a certain period of time only.
