Legal methods of REFUSING to take higher administrative work due to fragile health

Sir,

I am having fragile health and heart problem.My doctor advice total rest.

But I am working as a Professor in a Government university, and have still 12 years of service.

Due to seniority of scale of pay, I am to get appointed as the Head of the department.

However I believe that responsibility would put tremendous pressure on my
fragile health and endanger my life.

I want a legal way out of this situation and want to opt out of difficult administrative responsibility.

Since seniority and pay scale coming in the way of my refusal to accept higher admin. responsibility, I am ready to loose them, BUT DO NOT WANT TO RESIGN MY JOB.

I am ready to loose my higher pay scale and seniority so that others below me can take a lead.

I request advice on possible LEGAL steps I can take to escape assuming administrative responsibility.

What should I report to my university?

Can I seek my pay scale reversion to entry level?

You can definitely opt out from the promotion. You will not get higher pay scale applicable to the promotional post. But you will continue with the existing scale (there is no necessity to get reversal to the entry level) and pay stage.
In fact the Administration should not be averse to consider such a request and others juniors to you should be very happy that they would get promotion earlier than their expectation.

Dear Sir,

Thank you very much for your reply. I want to know in what manner (i.e. LEGALLY ACCEPTABLE AND TENABLE WAY) I should submit my request to permanently remove my name from the promotion and pay scale increments.

I am afraid that if I report my inability/unwillingness on health grounds, management may seek to put me in Voluntary retirement. I JUST WANT TO KEEP WHAT I HAVE AT PRESENT AND DO NOT WANT TO RESIGN.

Kindly advice the exact legal details of how I should put up my request (without endangering my present position).

You can say that since the promotional post involves more of administrative work than teaching job and you would love to continue to concentrate only on teaching job and not ready to take up any administrative job and therefore you may be taken out permanently from consideration zone for promotion to the higher post.
