Respected Experts, our apartment contains twelve flats.the common building fund is managed by two member committee which is not registered.now one major expenditure is required but the duo committee member is avoiding to show the balance in public eg.savings bank account passbook&fixed deposit certificates.other members are not taking initiatives.now how can I proceed alone to make them bound to show the balance in public?pl.advice Regards

First indicate whether the association of the flat owners are registered society or not. If yes then lodge complaint with the Registrar of the Societies. If not then you have file a case for injunction to restrain them from indulging in any illegal activities.

send them a protest letter and ask them to provide copy of the said documents. even under the bye laws they are bound to produce the records else approach the Authority either RCS or ROS as applicable

If you have not been granted any receipt for the payments made by you or there is no documentary evidence of the committee members keeping the funds, you won't have any legal remedy for any unaccounted money received by the members of an unrecognized or unregistered body, except causing some harassment by sending notice or lodging a police complaint. Naturally, if other members are not taking any interest, they are also against the proposed major expenditure.
So, better, first take the support of the other 5 apartments' owner members of the building, if you really want to take some reliable action against the two committee members. Otherwise all your efforts would go waste.

Respected experts, thanks for your valuable advices.can any member/flat owner demand for registration of the society? can any member/flat owner appeal to the registrar for audit of the common fund?
