Non-Signing of Bong...!

Querist : Anonymous (Querist) 20 February 2011 This query is : Resolved
Hi..
I have got better offer from one of the company..! I have not signed any bond or any other related document with the previous company but they have retained my original certificates..! I have worked for only 3 weeks with previous company.! Now while leaving company HR is asking me to pay bond amount of 50k without which they will not give away my original certificates..! They have said that if i am leaving without paying bond they will register me in NASSCOM and blacklist my name, which eventually results in non-employable by any company..!

Do i need to pay the amount in this regards..! What can be the legal aspects of if i am leaving without paying any amount.!

Kindly help me to resolve the issue..!

Thanks

no, you need not. your employer can not keep your certificate. you can lodge fir or can file complaint against your employer.

Since you have not signed any bond, you are not supposed to pay any amount to the employer towards bond.

Your employer cannot refuse to return the original certificates. In case of refusal, you can lodge an FIR.

Legaly you are not bound to pay any money. You can collect the documents and join in the new company.
