PF & other savings to wife

A professor of Bihar University died after 1 year of retirement.

He himself in his life couldn't receive all he was supposed to received from govt.

Whether his widow is liable to pension??
Whether his widow can receive all the money, he was suppose to receive??

Yes the widow is entitle to pension if she does not re marry. All other monetary benefits would be distributed among the deceased's legal heirs including his widow.

what about the LICs in his name? who will receive the money widow or nominated son/daughter in case son/daughter are not availiable?

Yes she is entittle for the pension and monetary benenefits of the deceased being a legal heir of the deceased. Other legal heirs of the deceased also entittle to claim share in the monetary benefits except pension.

As regards LIC amount, all the Class-I legal heirs of the deceased i.e. widowed wife, son(s) and daughter(s) and mother of the deceased are entitled to equal share. Nominee is only authorised to receive the money, but the said nominee cannot take the entire amount to oneself, but is expected to distribute the money received amongst the eligible legal heirs.

Of course, the right to pension rests with the widow of the diseased, if the Professor was on a pensionable job. The entitlement would be valid till remarriage or death of the widow. After that minor children, if any, of the Professor would be entitled to receive the pension.

About PF and LIC, only nominee would be entitled to claim as per the share indicated in the nomination filed with the PF and LIC controlling authorities.

However, if the nominee/s had already died before the death of the PF account holder/ LIC Policy holder, the legal heirship would have to be proved by other claimants for claiming the money.

terminal benefits of an employee is his rights, which he acquires after devoting his valuable period of life in the service of an employer. non payment of the same during the life time of the employee is not only illegal but is inhuman also. In the present case, the same were not given to him during is life time thus in my opinion the wife of the deceased employee is not only entitled for terminal benefits including the pension but also compensation for delay. My advise is to file writ petition immediately.
