138 n.i.act,not recipt of delivery of goods

in a case of of 138n.i.act,accused admiteed, that he has given cheque to petioner, but accused not receved goods,petioner has only bills carbon copy, jisme accused ke delivery recipt main signatyre nahi hai, accused ne sale of goods 1930 ka havala diya hai, va kumar export vs sharma carpets supreme court ke faisale ke aadhar par case khariz kar diya, faisle main likha hai ki sirf cheque dena hi paryapt nahi hai, varan mal delivery bhi sabit karni hogi, aapki kya rai hai

Faisla bilkul shi hai kyunki cheque lawful liability ke virudh jari kiya hona chahiye. agar mal pahuncha hi nhi to paisa dene ka dayeetav khda huwa hi nhi isliye cheque agar bounce ho bhi gya hai to bhi koi aprad nhi hai. complainant yahan doshi hai jiske virudh accused ko malicious prosecution ke karan mukadma dalna chahiye.

the point is "legally enforceable debt"

the complainant will have to prove this, keeping in view the provisions of S.138 NI Act.

mere existence of bill does not mean that there is some legally enforceable debt.

the judgment is good one.
