Dear friends, Is Section 163(A), MV Act, 1988 applicable for the Petitioner who himself is injured and accused in criminal case due to driving his vehicle without statutory valid insurance and driving licence? wrong doer is one and the same of offender? any reported citation against this?

Yes.He can file case u.s 163[A] of M.V. act against owener and insurance company.

Dear Sir, here Petitioner himself is owner of his vehicle and got injured and accused in criminal case due to driving his own vehicle without statutory valid insurance and valid driving licence? wrong doer is one and the same of offender or defaulter? any reported citation in favour of Insurance Company ? thanks in advance.

No, Vehicle is not insured and no valid driving licence. owner is not only victim but also accused. you intend to file petition against whom when accused, owner of the vehicle and driver, and in the last victim is one and the same person.
