hello,

I have presented a complaint u/s 138 N I Act. from Bank of india. after some time bank manager transffered... is new manager is competant to appear before the court in such case???

Earlier the old manager represented on behalf of the bank, now the new manager representing on the behalf of the bank.

Boss it is a common sence it is the duty of the manager, who is in office can deal with the matters relating to Bamk, as the Bank Manager speak only basing on record and not on personal knowledge

The Complaint severed to you was from Bank of India. The Manager who severed you the notice had done so under the powers conferred by the Bank, as such any change in the manager is authorised to handle your matter.

it is possible for civil suit but complainant u/s 138 N. I. Act is criminal proceding. and no law/rulings clear this point. if there is any law/ruling plz tell me
