Re: Registration of Property

Querist : Anonymous (Querist) 28 December 2010 This query is : Resolved
My father is four brothers including him. He is at the age of 60. My grandfather purchased a land in Patna. After his death all the four brothers resides in home constructed by the grandfather. All four brothers acquired the part in which they are residing and constructed as per their requirements. My mother is a LIC agent and as per earning they constructed their part in much planned manner.
Now I am the only son and my parents to avoid the future controversy wants to get the registered the property in their name. My parents pay the property texes and electricity bill for their part.
Now Except one aunty all the brothers are ready for the registration for their occupied portion, but aunty is not ready and she is telling that her space is lower than others portion. One more thing I want to mention that aunty is also enjoying the portion of eldest uncle and who has no objection for that. As the aunty has very good contacts in administration and police authority so everyone fears from her.
As my parents are old and they want to register the property in their life because they have a fear that in future aunty can play displeasure with the property.
Kindly suggest the legal solution to solve the issue and how the property can be registered in the name of my parents.
Aunty is third uncle's wife.

1- Aunty sister of Your father !

2- Your Father -four brothers can release their Deemed Joint rights in favour of other - three brothers in favour of one brother

3- There by each brother will get Registered Deed stating their exclusive rights on the portion of their respective parts with house/s constructed there on .

4- If aunty is sister of your father - her signature is also required ! But that can be attended at later stage also- by Ratification /or/ another release deed by her in favour of her four brothers-individually !

You can negotiate with Aunty inorder to make things go smooth, the very crux is that she wants some money from all of you and the one who likes more have to pay more!!!

Agreed with my Ld. Friend.
